If replacement goods cannot be found within a reasonable time then the full purchase price will be refunded. This warranty is personal to the person named on the invoice or warranty registration card and may not be transferred to any other person or company. If any material facts are withheld, false or fraudulent reports and/or claims are made then this warranty shall become void. In this event, any payments that have been made by Mitzybitz will be repayable forthwith. Under no circumstances Mitzybitz will entertain any claim(s) whatsoever in regard to labour costs/charges involved in fitting, removal and or changing of the parts supplied by the company. This warranty is void if any part supplied has been tampered with in any way. Seal broken, taken apart etc.

Please note all parts supplied are marked with our company stamps/initials and digitally recorded, removal of these marks will invalidate this warranty. No parts may be altered, modified or dismantled in anyway (except for routine service adjustment) without our permission. Failure to comply with these terms will invalidate this warranty. This warranty does not affect your statutory rights.

INSPECTION OF GOODS AND SIGN-OFF OF DELIVERY All goods should be inspected upon delivery before signing to ensure that the item has not been damaged in transit. If goods prove to be damaged, do not sign, refuse delivery & contact us within two working days.

If courier refuses you to inspect the goods, simply write the word 'Damaged' and then sign. This is to ensure that if necessary, a claim can be made against the Courier Company.

Once the item is in your possession the transaction is then complete and we cannot claim for “damage in transit” and therefore cannot offer a refund on damaged goods from that point on. DELIVERY Any item purchased from us must be paid for in full before the item can be released for delivery or collection. All items are shipped using various Uk courier companies ( TNT, DPD, Uk Mail or Royal Mail). Residents living outside Uk mainland should contact us before bidding as postage charges may be higher and we will have to get a quote from our reputable couriers.

Once items are shipped out, the shipping and handling fee is not refundable. Mitzybitz will not accept any responsibility for items 'damaged in transit' once they have been delivered and signed for by customers. All items will be checked and tested prior to packing before leaving Mitzybitz. If our delivery attempt to you is unsuccessful we will charge for delivery again which has to be paid in full before we make a second delivery attempt If the second delivery attempt fails we will not attempt again, so the item will have to be collected in person (unless otherwise agreed). Please note any delivery charges incurred are non-refundable. We will do our best to deliver your parts within two working days of your order within the Uk mainland and 3-5 working days to Scottish Highlands and other islands outside the U.K, where this is practical. Overseas shipping times cannot be guaranteed.

However, delays may sometimes occur which are outside of our control. Any date specified for delivery is therefore approximate only.

If delivery is delayed for more than 21 days, you have the right to contact us and refuse to accept the products. In these circumstances, we will refund any money paid by you for those products and delivery charges. However, we will not be responsible for any other losses, costs, damages or charges that you may suffer if we delay in supplying or do not supply those products.

At the time of delivery you will be required to validly sign-off on the delivery of the products, after which time the products become your sole responsibility. Please note, Bonnets, Doors, Wings, Bumpers and Glasses are very fragile due to their large thin profile and are therefore prone to damage. We therefore use specialist couriers to ship these parts to limited commercial locations within UK mainland only. If you wish to be assured of delivery please confirm this with us when placing your order. For larger pallet or boxed item(s), you will more than likely be contacted by our couriers prior to the item being delivered.

'Please ensure a valid and reachable mobile or landline contact number is supplied along with the payment on which you are easily reachable'. Delivery of the goods shall be made to the buyer's nominated address. It is the buyers’ responsibility to make all arrangements to take delivery of goods whenever they are tendered for delivery. When there is nobody to sign for the item(s) after an arrangement for delivery had been made between the courier and customer, the courier may attempt a second delivery at their discretion after which they will return the parcel to their depot. Customers will be given enough time to collect their item or contact the couriers but if there is no contact made then the parcel/pallet will be returned to us at a cost.

Courier policy is to attempt to deliver to your delivery address twice, after which they will put an attempted delivery card through your post box if nobody was there to sign for the item(s). The attempted delivery card is not posted for larger items on pallet as customers are contacted via telephone before delivery is attempted. If there will be nobody at your delivery address then you may instruct at the time of contact by couriers to leave with neighbour etc.

(Please note this is only at the couriers discretion if they allow certain parcels to be delivered elsewhere). However, if you do this and the goods go missing or are damaged it is your responsibility and there will be no replacement or credit. Unfortunately, we are unable to deliver to 3rd party Residential Addresses that are not confirmed on the eBay order details.

All deliveries will only be made to the registered PayPal/Credit Card address and will be made available to us on the eBay order details page. SHORTAGES OR DAMAGED GOODS In the event that a part(s) is supplied and prove to be incorrect or faulty upon fitting, Mitzybitz must be notified within 2 working days upon receipt of the goods in writing.

Collection can then be arranged; if a replacement is not available then a full refund will be offered. CORRECT PARTS SUPPLIED/ DELIVERED When a part is supplied correctly by us but you have made an error whilst ordering that part, Mitzybitz must be contacted within 2 working days in writing and the part(s) returned to us within 7 days of purchase for UK customers and 14 days of purchase for the overseas customers at the cost of the customer. All refunds made are subject to charging a handling fee of 20%. Please Note: due to an increase in wrongly ordered items (i.e.

People purchasing items to self-diagnose) we now charge a 20% restocking fee – this is to deter this practice, and is an unfortunate condition of sale that we have had to implement – postage will not be refunded in any instance. We cannot accept returns for items damaged as a result to being incorrectly fitted by unqualified persons. Returns for items that are not in working order will require written confirmation from a qualified auto electrician stating problems found. This item is in working order unless otherwise stated in the description, please see below for our returns policy should there be any issues. ENGINES/GEARBOXES WARRANTY The term “engine” refers to the cylinder head & block and the components which make these up (i.e. Pistons, cam shafts, con rods, etc.). Any ancillaries left on the engine including but not limited to the cam belt, water pump, sensors, water hoses or fuel system are left on free of charge and are not covered by this warranty (unless otherwise agreed in writing). All engines purchased must be installed by a qualified and recognised motor mechanic and must be fitted with a new timing/cam/oil pump belt(s)/chain(s), filled with new oil and filters upon installation before testing and/or use. Thermostat and temperature sensor(s) must be changed.

Failure to follow this procedure will result in the warranty being rendered null and void. Proof of Purchase and Professional Installation will be necessary to proceed with any Warranty claim. An Engine service must be carried out by a reputable garage after 500 miles were the oil and oil filter must be changed (Please note only use the type and grade of oil recommended by the original engine manufacturer). Manually adjustable tappets should be checked and reset as required and where applicable the cooling, fuel and ignition systems as well as auxiliary drive belts should be checked. Throughout the duration of this warranty the vehicle should be serviced at least every 7000 miles. Any necessary repairs or maintenance (whether covered by this Warranty or not) should be carried out as soon as is practicable and without further detriment to the condition of the engine. All ancillary parts should always be maintained in good order. We do not warranty engine failure or damage occurring directly or indirectly as a result of the following: a) Fault or failure arising from a fitting error or poor workmanship. B) Fault or failure of any ancillary components including but not limited to the cooling system, fuel system, turbo charger/exhaust and ignition system components, etc.

Nor are the ancillaries covered themselves. C) Where the vehicle has been used in conjunction with motor sports or marine situations. D) As a result of malicious damage.

E) As a result of fire or theft or a collision. F) As a result of overheating or lack of lubrication (due to insufficient coolant or lubricant).

The warranty does not cover gaskets and seals. For instance if an engine‘s head gasket should fail or if the engine is overheated then it will not be covered under our warranty. The warranty terminates if the engine temperature tabs (heat tabs) have been tampered with or removed.

Any modifications (including “performance”) or repair work undertaken without the written consent of Mitzybitz will invalidate the warranty. Vehicle recovery charges, hire car costs, loss of earnings, and any other consequential costs which might arise are not covered by this warranty.

If an engine needs to be replaced under the terms of this warranty, we require the faulty engine to be returned to our workshop before we can dispatch a replacement in order to conduct a mechanical investigative examination - the purpose of which is to safeguard both parties to identify any subsequent liability. Engines and gearboxes must be installed by a qualified mechanic to qualify for the warranty. Gearboxes must be filled with new oil to the correct level set by gearbox manufacture upon installation. Failure to follow this procedure will result in the warranty being rendered NULL&VOID. The warranty will only cover the parts supplied and will not cover any labour charges under any circumstances, please bear this in mind before placing orders. DAMAGED ITEM (ON SITE) Occasionally we discover that an item may have been damaged whilst in storage and as a result the item is unusable so we are unable to dispatch it.

We will initially make contact with the buyer of the occurrence and will try our best to source a replacement if possible. We reserve the right to cancel any order and refund the full amount paid by the buyer at any time. SURCHARGES (Exchange units) Surcharges must be paid on purchase of all exchange units. The surcharge will then be credited when the old unit has been returned has been returned and passed through our returns department. LAWS The Terms of Condition shall be governed by and construed fully in accordance with the law of United Kingdom & Ireland. That acceptance will be deemed as complete and to have been effectively communicated to you at the time. Mitzybitz sends the email to you (whether or not you receive the e-mail). All orders for goods shall be deemed to be an offer by the buyer to purchase goods pursuant to these conditions.
